Welcome to BakeryCost. By accessing or using our website, tools, calculators, software, and services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). Please read them carefully. If you do not agree to these Terms, you may not use the Service.
1. Description of Service
BakeryCost provides online software, tools, and business management solutions designed for small and medium-sized bakeries, home bakers, and cottage food operators (collectively, “Users”). Services include recipe costing, inventory management, order tracking, invoicing, online storefront creation, and educational resources.
2. Account Registration and Security
- Eligibility: You must be at least 18 years old or the legal age of majority in your jurisdiction to create an account.
- Accuracy: You agree to provide accurate, current, and complete information during registration and to keep your account details updated.
- Security: You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
3. Use of the Service and Prohibited Conduct
You agree to use the Service only for lawful business purposes. You shall not:
- Use the Service to violate any local, state, national, or international laws, including cottage food regulations and food safety standards.
- Reverse engineer, decompile, or attempt to extract the source code of our tools and software.
- Use any automated systems (robots, spiders, scrapers) to access or harvest data from the Service without our prior written consent.
- Misrepresent your identity, bakery business, or pricing data to deceive consumers.
4. Subscriptions, Fees, and Payments
- Paid Plans: Certain features of BakeryCost may require a paid subscription. Fees and billing cycles are detailed on our pricing page.
- Billing: By providing a payment method, you authorize us to charge the applicable recurring fees. All fees are exclusive of applicable taxes.
- Cancellations and Refunds: You may cancel your subscription at any time through your account settings. Unless otherwise stated, fees are non-refundable, and you will retain access until the end of your current billing cycle.
5. User Content and Data Ownership
- Your Data: You retain full ownership of all data, recipe details, customer info, images, and content you upload to BakeryCost (“User Content”).
- Our License: You grant BakeryCost a worldwide, non-exclusive, royalty-free license to host, store, and process your User Content solely to provide and improve the Service.
- Data Privacy: Your data handling is governed by our Privacy Policy.
6. Intellectual Property
All content, design, software, code, logic, calculators, formulas, logos, and branding elements on BakeryCost are the exclusive property of BakeryCost and are protected by copyright, trademark, and other intellectual property laws.
7. Disclaimers and Limitation of Liability
- “As-Is” Basis: The Service, including all financial calculators and recipe costing tools, is provided on an “as-is” and “as-available” basis. We do not guarantee that calculations will be error-free or that using the tools guarantees profitability.
- No Professional Advice: BakeryCost does not provide legal, tax, accounting, or professional food safety advice. You are solely responsible for verifying your compliance with local laws and financial regulations.
- Limitation of Liability: To the maximum extent permitted by law, BakeryCost shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business goodwill.
8. Termination
We reserve the right to suspend or terminate your account or access to the Service at our sole discretion, without notice, for conduct that violates these Terms or is harmful to other users, us, or third parties.
9. Changes to the Terms
We may update these Terms from time to time. We will notify you of any material changes by updating the “Last Updated” date at the top of this document or via email. Continued use of the Service after changes constitute acceptance.
